Lahaina Board Update for December 2025

The Lahaina Board continues to meet weekly to address the many issues arising as it prepares for the vote on the Amendments leading to the clearing of owner’s titles in preparation for a future sale of the property. The Amendments will bring our by-laws in line with state law and allow for most actions concerning Lahaina to be approved by a simple majority. The real estate market on Fort Myers Beach has settled into a somewhat slower pattern, but is ready for the next round of activity.
Due to the upcoming holidays, the Board will not be sending out the Amendments with proxies until mid-January. These will come by email to those who have returned their consent forms, and by mail to those who have not. If you want to help us save money, please send in your consent form allowing for documents to come by email. We will alert owners when those emails and mailings are sent on our official email and official website. If your address or email has changed, please call Lahaina (239-463-4414) and leave a voice mail with the changes, or email [email protected], so we can update our records before mid-January.
A virtual owner’s meeting will take place approximately 30 days after the Amendments have been mailed to announce whether the Amendments have passed. Please send your proxies in as soon as you receive them so that we do not have to delay or repeat this process. The date for this meeting will be included in your voting packet.
Again, the Board will alert you when the emails and mailings go out and the documents you receive will have instructions on where to send your proxies.
An important tip to remember and prepare for: There will be two Amendments in the package, one for Phase One of Lahaina (Units 11-25) and Phase Two of Lahaina (Units 26-47). Some owners may own units in both Phase One and Phase Two so will need to vote for both Amendments. This will be explained in the documents and again in the notice from the Board.

11/10/2025 UPDATE:

The Board would like to clarify that we have decided not to pursue rezoning the property at this time. We understand that many owners have reached out with questions regarding the potential costs associated with rezoning.
We hope you were able to attend the recent Town Hall meeting with the Association’s attorney—or have since viewed the recording—where he outlined the steps required to proceed with a property sale when the time comes. For your convenience, the link to that recording is provided below.
We are also including a separate link where owners may submit questions about this process after reviewing the attorney’s presentation.
Looking ahead, we will be holding an Owner Meeting in early December to complete the first amendment pertaining to Phases I and II. Proxies for the proposed amendment, and a formal notice with the webinar link will be distributed soon.
If you have not yet submitted your electronic consent form, we encourage you to do so. This helps the Association reduce mailing costs and avoid potential delays with USPS delivery.

We will also record this Townhall where our association attorney goes over the steps we have to go through in order to have clear title to be able to close on a property sale. The recording will be posted to our website in the owners section next week.

We will be holding a Townhall this coming Thursday, October 16th at 5:30pm ET. The webinar link will be posted in the owners section of our website this Tuesday. We have put together a link, https://forms.gle/Cna7chQzCLEJ9qdf8, where you can submit questions you have pertaining to this process. The board will compile these and have the association attorney answer them during the Townhall. Please submit your questions by 6pm ET Tuesday, October 14th.
7/18/2025 UPDATE:
Lahaina Owners,
We will be sending out a notice and agenda for a owners meeting within 30 days. The association attorney is recommending we amend some of our docs to make it easier to pass terminating the corporation when the property sells. Once we have the mailings ready we will post here with the meeting date and time.
5/23/24 UPDATE:
Lahaina Management and Board members are still working behind the scenes to sell the property.
Over the past few weeks, Board members and management have had a number of meetings with our attorney to discuss the steps still needed in order for us to be able to dissolve the association and receive clear title. We are planning to have an Owners Meeting in the near future. We will provide more information concerning this once we have established the time and date.
There will be information going out to all owners. The most cost efficient and fastest way to get this out to you will be by email. Please make sure we have a current email address for you. It is important that we have your updated contact information. Please email [email protected] with this information.
We understand not all owners are on social media. Please feel free to pass along this information to any family and friends that are owners and may not see this post.

Subject: How You Can Help Support the Property Sale Process
Lahaina Owners,
We have received inquiries from several of you about how you can assist with the process of selling the property on Fort Myers Beach. Many properties remain vacant since Hurricane Ian, as developers are closely monitoring the situation to better understand what the Fort Myers Beach Town Council will permit in terms of new construction. The Town Council has initiated a public review process to justify any deviations from the current town plans, but this approach has created a sense of uncertainty and risk among potential buyers. The Town Council says you need to offer public benefit to get any variance. But they do not say what public benefit will get what variance.
As a community, we are faced with a challenge: many refuse to envision a future other than that of the old Fort Myers Beach, which was unfortunately wiped out by Hurricane Ian. For many homeowners, rebuilding or re-establishing a viable property is simply not feasible, leading to an increasing number of properties for sale.
We believe the best way to move forward is for the Town Council to provide clearer definitions and guidelines, particularly regarding the variance process, which would help reduce the uncertainty for buyers and property owners alike.
